Nach mehreren gescheiterten Versuchen, den populären Slogan „Vom Fluss bis zum Meer, Palästina wird frei sein” unter Strafe zu stellen, geht die Berliner Justiz nun aufs Ganze!
Normalerweise wird die Verwendung des Slogans unter dem Tatbestand „Verwendung verfassungswidriger Symbole“ strafrechtlich verfolgt und von einem lokalen Gericht behandelt.
Dieses Mal wirft der Staat der Person die „Verbreitung von Propagandamaterial verfassungswidriger und terroristischer Organisationen“ vor.
Diese Anklage bedeutet, dass der Fall vor einem höheren Gericht des Staates verhandelt wird. Mit anderen Worten: Durch die Verknüpfung des Slogans mit dem Vorwurf der terroristischen Propaganda konnte der Staat dieses Verfahren eskalieren und sich über die lokalen Gerichte hinwegsetzen!
Was bedeutet das? Anders als in normalen Gerichtsverfahren, in denen eine Berufung eine erneute Prüfung des Falles bedeutet, führt die Berufung in diesem Fall sofort zum höchsten Gericht des Landes – dem Bundesgericht.
Der Staat nutzt die Gelegenheit, um gegen den populären Slogan vorzugehen, sodass jede negative Entscheidung für alle anderen Fälle der Kriminalisierung von „Vom Fluss bis zum Meer, Palästina wird frei sein” verwendet werden kann und wird.
Abgesehen von den technischen Details, wie sie versuchen, es zu verbieten, ist der Slogan eine politische Aussage, die das Streben nach einem befreiten Palästina zum Ausdruck bringt.
Ein Palästina ohne Kolonie. Ein Palästina ohne Zionismus. Ein Palästina ohne Apartheid und Völkermord. Und genau das versuchen sie zu kriminalisieren. Den bloßen Gedanken an eine bessere Zukunft. Und das wird ihnen niemals gelingen.

After multiple failed attempts to criminalize the popular slogan „From the River to the Sea, Palestine will be Free“, the Berlin justice system is going all out!
Normally, using the slogan is prosecuted under the „use of unconstitutional symbols“ and would be handled by a local court.
This time, the state is accusing the person of distribution of propaganda material of unconstitutional and terrorist organisations“.
This accusation means that the case is handled at the state’s higher court. In other words, by linking the slogan to a charge of terrorist propaganda, the state was able to escalate these proceedings and overstep the local courts!
What does this mean? Unlike in normal court cases where an appeal means the re- examination of the case, the appeal in this case will lead immediately to the highest court in the country – the federal court.
The state is using the opportunity to go after the popular slogan, so any negative decision can and will be used for all other cases of criminalising „From the River to the Sea, Palestine will be Free“.
Beyond the technicalities of how they’re attempting to ban it, the slogan is a political statement expressing the aspiration of a liberated Palestine.
A Palestine without the colony. A Palestine without Zionism. A Palestine without apartheid and genocide. And that’s exactly what they’re trying to criminalize. The mere thought of a brighter future. And they will never succeed.
