Begleitet uns vor Gericht zu einem weiteren Fall von „Vom Fluss bis zum Meer, Palästina wird frei sein“. Die Person, die vor Gericht steht, hatte diesen Slogan in ihrem Twitter-Benutzernamen. Der Staat wirft ihr vor, einen Slogan der „Hamas“ verwendet zu haben, und nutzt die Charta der Bewegung aus dem Jahr 2017 als „Beweis“.
Wenn wir uns die Charta ansehen, stellen wir fest, dass sie den Slogan nicht wörtlich enthält, sondern sich vielmehr auf das bezieht, was die Bewegung als Befreiung Palästinas betrachtet:
„Palästina, das sich vom Jordan im Osten bis zum Mittelmeer im Westen und von Ras al-Naqurah im Norden bis Umm al-Rashrash im Süden erstreckt, ist eine integrale territoriale Einheit. Es ist das Land und die Heimat des palästinensischen Volkes.
Die Vertreibung und Verbannung des palästinensischen Volkes aus seinem Land und die Errichtung der zionistischen Entität darin heben das Recht des palästinensischen Volkes auf sein gesamtes Land nicht auf und begründen keine Rechte für die usurpatorische zionistische Entität darin.“
In der Charta heißt es weiter: „Die Hamas lehnt jede Alternative zur vollständigen und umfassenden Befreiung Palästinas vom Fluss bis zum Meer ab.“
Es ist wichtig, sich daran zu erinnern, dass auch die erste Charta der PLO von 1964 besagt: „Palästina mit seinen Grenzen zur Zeit des britischen Mandats ist eine regionale, unteilbare Einheit.“ Nach dem Beginn der modernen palästinensischen Revolution wurde die Charta der PLO 1968 von allen damals militanten palästinensischen Fraktionen neu verfasst. Der Artikel „Palästina mit den Grenzen, die es während des britischen Mandats hatte, ist eine unteilbare territoriale Einheit“ blieb unverändert.
Mit anderen Worten: Der Slogan drückt nicht nur eine legitime antizionistische politische Position aus, die weltweit von der Solidaritätsbewegung für Palästina geteilt wird, sondern auch ein Prinzip, das im palästinensischen Befreiungskampf verankert ist und so alt ist wie der Kampf selbst. Den Slogan zu kriminalisieren bedeutet, den palästinensischen Befreiungskampf zu kriminalisieren. Und genau das versuchen sie zu tun.

Join us in court for yet another case of „From the River to the Sea, Palestine will be Free“. The person standing in front of court had the slogan in their twitter username. The state is accusing them of using a „Hamas“ slogan, using the movement’s charter in 2017 as „evidence“.
If we look at what the charter states, we see that it doesn’t contain the slogan word for word, but rather refers to the what the movement considers the liberation of Palestine:
„Palestine, which extends from the River Jordan in the east to the Mediterranean in the west and from Ras al-Naqurah in the north to Umm al-Rashrash in the south, is an integral territorial unit. It is the land and the home of the Palestinian people.
The expulsion and banishment of the Palestinian people from their land and the establishment of the Zionist entity therein do not annul the right of the Palestinian people to their entire land and do not entrench any rights therein for the usurping Zionist entity.“
The charter also states: „Hamas rejects any alternative to the full and complete liberation of Palestine, from the river to the sea.“
It’s important to remember that the PLO’s first charter of 1964 also states: „Palestine with its boundaries at the time of the British Mandate is a regional indivisible unit.“ And after the launch of the modern Palestinian revolution, the PLO’s charter was rewritten in 1968 by all Palestinian militant factions at the time. The article „Palestine, with the boundaries it had during the British Mandate, is an indivisible territorial unit.“ remained unchanged.
In other words, the slogan expresses not only a legitimate antizionist political position shared worldwide by the Palestine solidarity movement, but a principle enshrined in the Palestine liberation struggle as old as the struggle itself. To criminalize the slogan is to criminalize the Palestine liberation struggle. And this is exactly what they’re trying to do.
